Estate Planning
Hudson Law LLC can organize your estate so that you don't have to worry about what happens to your family when you leave this world. Everyone can be taken care of according to your wishes. Too many of us put our families through unnecessary chaos, confusion and strain because we neglect to organize our affairs in the form of a will or a trust. Many of us don't like to think about our end of life plans, but your family, your descendants, will greatly appreciate it. So, to avoid inflicting more frustration and sorrow unto your loved ones if you fall ill and/or after your departure from this life, let's talk about estate planning.
Top Benefits of a Revocable Trust
1. Avoiding Probate
Whether you have a will or not, your estate will have to go through probate after your death, which means your heirs or beneficiaries will have to complete a court process before they can inherit anything from your estate. The court process could take months or years.
Having a revocable trust avoids the court process and can distribute your estate to your beneficiaries immediately upon your death.
2. Maintaining Privacy
Keeps your estate details and beneficiary distributions private, unlike a will that is public record.
3. Managing Incapacity
Designate a someone to handle your financial matters if you become ill or disabled, which avoids the need for a court-appointed conservatorship.
4. Ability to Change Your Mind
After establishing your revocable trust, if situations change, you can amend or completely revoke your trust to suit your needs.
5. Our Firm Includes Additional Documents with Your Revocable Trust
Pour-Over Will – A will that catches any stray assets left outside of the trust and routes them into it upon death. The goal is to put all assets into the trust so that the pour-over will is not needed because it would defeat the trust purpose of avoiding probate.
Georgia Advance Directive for Healthcare – Appoints a healthcare agent and outlines your end-of-life medical wishes.
Durable Financial Power of Attorney – Authorizes someone to manage your financial accounts and business affairs during your incapacity.
HIPPA Form - A separate, standalone HIPAA release allows your agent to talk to doctors or access records during a minor or temporary crisis before total incapacitation occurs.
The net benefit of having a comprehensive revocable trust package is total control, privacy, and the elimination of court intervention both during your life and after your death.
